01 Acceptance of Terms

By accessing, browsing, or retaining the professional construction, engineering, and property development services of Ibrahim George Dardas, you unconditionally agree to comply with and be bound by these Terms & Conditions. These terms govern all design consultations, site evaluations, master-planning, project management, and turnkey delivery services executed under our administration. If you do not agree, you must immediately cease site operations and digital engagement.

02 Services Description

We provide comprehensive construction administration, property development guidance, structural engineering coordination, and principal contractor services across New South Wales and Queensland. All structural outcomes are managed in strict adherence to national building codes, local council planning schemes, and approved architectural blueprints. Services are refined continuously to align with modern turn-key technologies and rigorous civil engineering parameters.

03 Project Quotations & Estimates

All project tenders, cost estimations, bill of quantities, and development feasibility appraisals provided by our studio are valid for exactly thirty (30) business days from the date of issue. These figures remain subject to adjustment based on unanticipated geotechnical conditions, rapid material cost volatility, structural design variations requested by the client, or municipal planning authority mandates.

04 Payment Terms

Payments must be disbursed in strict accordance with the progressive milestone schedule detailed in your Master Building Contract. Milestone claims are issued upon the certified completion of key stages (e.g., slab pour, framing, lock-up, practical completion). Invoices carry a strict 7-day payment window. Late payments will incur an interest penalty calculated at 1.5% per month on outstanding balances, and may result in immediate suspension of site works.

05 Project Timelines & Delays

While we make every commercial effort to execute construction within specified schedules, all timelines remain estimates only. We accept no liability for progressive project delays arising from slow municipal council approvals, material supplier supply chain failures, inclement wet weather, specialized labor shortages, or design modifications introduced by external civil architects during active building phases.

06 Intellectual Property

All architectural concepts, structural blueprints, raw engineering models, 3D renderings, and proprietary development plans generated by Ibrahim George Dardas remain our exclusive intellectual property. Client is granted a non-exclusive, non-transferable license to use these documents solely for the physical execution of the specific site and property development project outlined in the active master agreement.

07 Limitation of Liability

To the maximum extent permitted by Australian consumer law, our total aggregate liability for any operational loss, structural defect, professional negligence, or contract breach shall be strictly capped at the direct physical fee value received for our engineering or advisory consultancy services. We are not liable for any consequential commercial loss, project delays, profit drops, or site holding costs.

08 Indemnification

The client agrees to defend, indemnify, and hold harmless Ibrahim George Dardas, our project coordinators, and site personnel from any claims, legal liabilities, structural damages, and administrative fees arising from client-directed breaches of local planning permissions, unauthorized site entries, or interference with professional building sub-contractors.

09 Warranty & Defects Liability

All structural and non-structural building elements are backed by standard statutory warranties under the NSW Home Building Act 1989. A strict twelve (12) month non-structural defects liability period commences immediately from the date of practical completion. Any discovered defects must be formally submitted in writing to our head office within this window for evaluation and physical rectification.

10 Dispute Resolution

In the event of an operational dispute regarding construction standards, billing claims, or contractual delays, both parties agree to first seek resolution through formal mediation in Sydney, Australia. If mediation fails to resolve the matter within forty-five (45) business days, the dispute shall be referred to binding arbitration or relevant building tribunals.

11 Force Majeure

Neither party shall be held liable for failure to perform project obligations due to events beyond reasonable human control, including but not limited to severe natural disasters, long-term labor strikes, acts of war, global pandemics, government-mandated site shutdowns, extreme weather anomalies, or state-wide infrastructure failures.

12 Termination

A professional building agreement may be terminated by either party upon thirty (30) days written notice in the event of a material, unrectified breach of contract. Upon termination, the client shall remain immediately liable to settle all outstanding costs for site work completed, materials ordered, and subcontractor commitments made up to the effective termination date.

13 Governing Law

These Terms & Conditions are governed strictly by the laws of the State of New South Wales, Australia. Both parties submit unconditionally to the exclusive jurisdiction of the courts of New South Wales and relevant Commonwealth tribunals for all legal disputes and contract enforcement actions.
